AGB / General Business Policy of Vimex Europe B.V.

VALIDITY:

The business relation between customer and Vimex Europe B.V. is defined by these trading conditions in their - at the time of ordering - newest valid version.  Any changes require our written confirmation.  We reserve the right
to change these conditions at any time.  It is the customer's responsibility to stay informed about any possible changes of these trading conditions prior to each purchase. These trading conditions are subject to the laws of
the Netherlands and must be accordingly applied, unless different law regulations exclude this compellingly.  In trade with final consumers from other European Union countries also the law of their homeland is applicable, if it deals compellingly with consumer-legal regulations.


CONTRACT:

Our offers are not binding without closing a contract.  Vimex Europe B.V closes a contract with acceptance of the order. The acceptance takes place for on-line orders by forwarding our order confirmation by email.  In the case of telephone orders the confirmation of order can take place in written form or by telephone.  The acceptance of the order can also take place via shipment of the order (e.g. with written orders).  The customer is responsible for supplying the complete and correct ship-to-address.  The contract will not close, if the customer cannot be reached or verified during acceptance or confirmation of the order.  Vimex Europe B.V. is not obligated to accept a contract.  This can happen e.g. in case of writing or legal mistakes, mistakes in the Website as well as being unable to fill the order.

PRICING:

All prices specified on our web site include the government imposed value added tax (VAT) and are quoted in EUR.  Mistake, misprint, price- and technical changes remain reserved.  Only prices published on our website at the time of ordering apply (this is also valid for any special pricing!).  Minimum purchase order value is EUR 25,00 (exclusive shipping charges).  Below we are not obligated to fill the order.


SHIPPING:

We will start working on your order as fast as possible and in the order received.  Typically we ship within 48 hours by post office or with other carriers and - according to our experience - shipping time will then be about 2 - 3 working days.  Articles not immediately available for shipping will be backordered and shipped free of charge right after receipt from our suppliers.  We are not obliged to ship on a certain date or within a certain time period.

Orders valued EUR 100,00 and above are shipped free of charge. Below a total of EUR 100,00 we will charge EUR 6,00 for shipping and handling.  For shipments going to Switzerland, Austria, Belgium, France, Greece, Italy, Luxembourg, Portugal, Spain and the Scandinavian countries we charge an additional amount of EUR 6,50 - and with a purchase order value above EUR 100,00 a total of EUR 6.50 for shipping and handling.  For all other countries we will charge our expenses, however, the minimum charge is EUR 8,50.

For all C.O.D. shipments the carrier will collect an additional fee.

The shipment is immediately to be examined by the receiver for completeness and/or correctness.  Any problems must be reported as soon as possible - either via telephone or email.  Complaints, which reach us later than 10 days after receipt of the shipment, cannot be accepted anymore!  Damaged shipments must be confirmed as such with receipt from the carrier prior of return.


PAYMENT:

All order contracts will be invoiced in Euro.  For sake of simplicity we offer several different payment methods.  Therefore, when placing an order, you can select the method most convenient for you.  We reserve the right to limit - in individual cases - the free selection of payment methods, e.g. in case of poor credit history and/or with higher purchase order values.  In order to avoid unnecessary costs we ship only against C.O.D. or prepayment (e.g. bank transfer or cheque).  In addition we accept all major credit cards as well as all bankcards with Visa and/or MasterCard Logo (all processing will be handled in our name by the company Fa. Worldpay through safe and direct debiting.  Under no circumstances we will ever receive any data about your credit and/or debit card transactions!).  In case of unsuccessful credit- or debit-card processing the order contract remains valid and obligation for payment will persist.  The ordered items remain always sole property of Vimex Europe B.V. until full completion of payment.


WARRANTY AND PRODUCT LIABILITY:

We guarantee that the supplements ordered from us are free of factory (production) and material defects.  The warranty period is 12 months starting from receipt of shipment.  For all products with shorter expiration date our guarantee ends with reaching that respective date.  There is no warranty or liability for normal decay or in case of inappropriate handling by the customer. In the event of warranty we reserve the right to choose - and only after receipt of the items in question - either to cure the complaint by exchange or to repay the purchase price.  Further claims and in particular additional claims for damages are generally excluded, insofar as the respective damage was not caused from the supplier's side purposely and/or through negligence.  The liability covers maximally up to the total value of the order contract.  Vimex Europe B.V. is not responsible, if the receiver cannot be found at the indicated ship-to-address at the scheduled delivery date.


REFUND POLICY:

Within 10 days after receiving the shipment, the package can be returned for any reason - and no questions will be asked.  In this case we kindly ask you to inform us (within the 10 days deadline!) either by telephone or via
email.  We will then send you a postage free return-shipment label and instructions.  After receipt of the return-shipment we will immediately issue a credit note for your and our accounting and according to your instructions either hold the funds for exchange or return the respective funds to you the same way we did receive the payment - without any deduction.


DATA SECURITY:

We will store your address data only for our internal purposes.  Passing on or sale of your data to third parties for advertising and marketing does not occur under any circumstances!


SALVATORIAN CLAUSE:

Should individual paragraphs of these AGB's be totally or partially invalid, or should these AGB's in any way be incomplete, then the validity of all other regulations remains unaffected.  Respective legal paragraphs will then step in to replace the ineffective or missing regulations.


PLACE OF FULFILMENT AND COURT OF JURISDICTION:

In each case and under all circumstances place of fulfillment and court of jurisdiction is always NL-1217 SW Hilversum.
